Consent Orders

By far the most common way to get a legally binding financial separation agreement with your former partner is called a Consent Order.

In essence, this means asking the Family Court to review and approve your proposed arrangements.

Many separating couples use Consent Orders to cover matters like:
  • assigning ownership of their family home from joint title to sole title;
  • one of them taking over responsibility for the mortgage;
  • agreeing to sell property and split the net proceeds in a defined proportion;
  • making a cash settlement payment from one to the other;
  • transferring some superannuation from one to the other;
  • assigning cars;
  • agreeing who is responsible for paying a credit card or other debt;
  • and, very importantly, agreeing that neither has any further claim against the other.

Consent Orders can also be used for formalising arrangements regarding children.
